TERMS AND CONDITIONS

Instagram & Facebook Competition

 

  1. 1.    This I Love Fragrance Miss Posh Glam Instagram and Facebook Competition (“Competition”) is organised and conducted by Indigo Brands (Pty) Ltd, a subsidiary of AVI Limited, and Miss Posh Glam blogger, including their affiliates, partners, associations and agents (“Promoters”).

 

  1. 2.    This Competition will run from 5 June till 12 June 2017. Closing time of competition is midnight on the 12th June. Entries received after the closing date and time will not be considered.

 

WHO CAN ENTER?

 

  1. 3.    Participants must be 13 (thirteen) years or older (if under 18 (eighteen) years old, you must be duly assisted by your legal guardian) and have a valid identity document or passport and reside in the Republic of South Africa during the period of the Competition, up to and including the dates of determination of the winners and prize redemption dates (“Participants”/”you”/”your”). 

 

  1. 4.    Participants may not enter or receive a prize if they are directors, members, partners, employees, agents of or consultants of the Promoters, their subsidiaries, holding companies, divisions and/or associated companies or of the advertising or promotion agencies or any other person who directly or indirectly controls or is controlled by either of the Promoters, or their spouses, life partners, immediate family members or business partners. 

 

  1. 5.    The Competition is not open for entry by or on behalf of a legal entity and Participants cannot use the account of a legal entity to enter the Competition. Entries must be submitted by the Participant themselves and not by a third party on the Participant’s behalf.

 

  1. 6.    By entering this Competition, all Participants agree to be bound by these terms and conditions, which will be interpreted by the Promoters and the Promoters’ decision regarding any issue with the Competition will be final and binding and no correspondence will be entered into. 

 

HOW TO ENTER

 

  1. 7.    To enter via Facebook Participants must –

 

Step 1: Tell us which I Love Fragrance variant (I Love Vanilla, I Love Candy, I Love Flowers, I Love Musk) is your favourite by commenting on the Competition post on the Miss Posh Glam Facebook page 

Participants must use the whole phrase “I Love Vanilla” / “I Love Candy” / “I Love Flowers” / “I Love Musk” for their entry to be viable and go into the draw. 

 

Step 2: Tag Miss Posh Glam in your comment

 

Step 3: Use the hashtag #ILove and #ilovexmissposhglam.

 

  1. 8.    To enter via Instagram Participants must –

 

Step 1: Tell us which I Love Fragrance variant (I Love Vanilla, I Love Candy, I Love Flowers, I Love Musk) is your favourite by commenting on the Competition post on the Miss Posh Glam Instagram account @missposhglam. 

Participants must use the whole phrase “I Love Vanilla” / “I Love Candy” / “I Love Flowers” / “I Love Musk” for their entry to be viable and go into the draw. 

 

Step 2: Tag in your comment @missposhglam

 

Step 3: Use the hashtag #ILove and #ilovexmissposhglam

 

  1. 9.    Note: an entry is only valid if all 3(three) of the above steps are taken on a particular social media platform.

 

  1. 10.    Entries are limited to 1 (one) Facebook entry per Participant and 1 (one) Instagram entry per Participant. Only the first entry received on that social media platform will be considered and go into the draw. The maximum amount of entries you can have is 2 (two) if you enter on both Facebook AND Instagram. If you only enter on Facebook OR Instagram you will only have 1 (one) entry into the draw. Each entry must contain 1 (one) of the following I Love Fragrance variants: I Love Vanilla, I Love Candy, I Love Flowers, or I Love Musk to be valid. If there is more than 1 (one) I Love Fragrance variant in an entry, the entry will be disqualified.

 

  1. 11.    Winners will be determined by a random draw. There will be 1 (one) random draw with all entries received on both the Facebook and Instagram platforms. Judges decisions are final and no correspondence will be entered into.

 

  1. 12.    Participants are required to have their own personal Facebook or Instagram account.

 

  1. 13.    Incomplete or incorrect entries will not be eligible to be considered or entered into the draw.

 

  1. 14.    Participants are responsible for their own costs of connecting to Facebook, Instagram and the internet. No responsibility is accepted for any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt.

 

PRIZES

 

  1. 15.    There is 1 (one) grand prize and 4 (four) runner up I Love Fragrance hamper prizes to be won. 

 

  1. 16.    The grand prize consists of a Zando voucher to the value of R2 000.00 (two thousand rand) and a I Love Fragrance hamper.

 

  1. 17.    The I Love Fragrance hampers are to the value of R 999.00 (nine hundred and ninety-nine rand) each. 

 

  1. 18.    The I Love Fragrance hamper consists of 4 (four) 15ml Eau De Parfums valued at R69.95 (sixty-nine rand ninety-five cents) each; 4 (four) 50ml Eau De Parfums valued at R119.95 (one hundred and nineteen rand ninety-five cents) each; and 4 (four) Personal Body Sprays valued at R19.95 (nineteen rand and ninety-five cents) each and 1 (one) Bluetooth speaker valued at R160.00 (one hundred and sixty rand) each.

 

  1. 19.    The grand prize winner will be subject to the Zando voucher terms and conditions.

 

  1. 20.    Prizes are non-transferable or redeemable for cash. 

 

  1. 21.    The prizes may differ from that shown on the promotional material with regard to illustrations, images, colour and specifications and same shall be subject to availability and in the Promoters’ sole discretion to select same.

 

  1. 22.    The Promoters reserve the right to substitute the prizes for an alternative prize of equal or greater value should the prize promoted not be available for any reason.

 

  1. 23.    The prizes do not cover any other costs of the winner whatsoever.

 

DETERMINATION OF WINNERS

 

  1. 24.    Winners will be determined by a random draw after the close of the Competition. 

 

  1. 25.    The winners will be contacted via direct message by MissPoshGlam to their Facebook or Instagram account. Winners will be contacted as soon as reasonably possible after the determination of the prize winners taking place. Participants are advised to monitor their Facebook or Instagram account for any such notifications. 

 

  1. 26.    The Promoters will make 1 (one) attempt to contact and notify the selected potential winner. If the selected potential winner does not respond to the notification by contacting the Promoters within 48 (forty-eight) hours, or if after first being contacted by the Promoters, is not reachable, or the potential winner fails to provide the Promoters with the required information to hand over the prize, the potential winner will forfeit the prize and a replacement winner will be selected from remaining qualifying Participants. This process shall continue until the winner has been contacted in terms of the terms and conditions.

 

  1. 27.    After the closing date, and once the winners have been contacted, the winners will be announced, subject to the winner’s consent.  

 

  1. 28.    Participants must ensure that the settings on their Facebook and/or Instagram account allow for them to participate in the Competition and for the Promoters to see their posts. The Promoters will not be liable for any “hidden” posts or entries. Only entries that are visible to the Promoters at the cut-off time will be considered.

 

  1. 29.    Once the MissPoshGlam have received the contact details from the potential winner, he/she will be required to furnish the Promoters with their full name, identity number and answer questions as required in terms of the Consumer Protection Act. If the potential winner qualifies, the Promoters will arrange for delivery of the prize.

 

  1. 30.    The Promoters reserve the right to select an alternative winner in the event that they reasonably believe, in their sole discretion, that the winner is not eligible to win, the post is not relevant to the criteria set out above, has contravened any of these terms and conditions, Instagram Terms and/or the Facebook Terms, has created multiple Facebook or Instagram accounts in order to enter more than permitted, acted fraudulently with regards to the Competition, has acted in a manner that is not in the spirit of the Competition, their conduct can be reasonably interpreted as scamming or circumventing the rules of the Competition, acted fraudulently with regards to the Competition if it would be unlawful to award the prize or if the winner fails to accept the prize after 2 (two) attempts for any reason whatsoever, if after first being contacted by the Promoters, is not reachable, or the winner fails to provide the Promoters with the required information to hand over the prize. In this instance the winner will be disqualified and forfeit the prize. The Promoters’ decision shall be final and no correspondence will be entered into.

 

RESTRICTIONS ON CONTENT OF COMMENT

 

  1. 31.    The Promoters reserve the right to remove any comments and content uploaded should this be deemed unsuitable by the Promoters.  All content is published at the discretion of the Promoters. 

 

  1. 32.    Any comment or other material uploaded by users do not necessarily reflect the Promoters’ views or ideals. The Promoters do not warrant the accuracy of any statement made by Participants.

 

  1. 33.    Comments that are uploaded must be original.

 

  1. 34.    Participants participate at their own risk and take responsibility for all comments under their Facebook or Instagram account and information provided.

 

  1. 35.    The comment cannot violate the copyright or other rights of any third party.  

 

  1. 36.    The comment cannot include inappropriate, offensive, illegal or obscene material or gestures (e.g., hate speech or pornographic images).

 

  1. 37.    The comment cannot disparage, reflect poorly upon or otherwise adversely affect the goodwill and/or reputation of the Promoters.

 

  1. 38.    The comment must be relevant to the theme of the Competition. 

 

  1. 39.    Any comment determined by the Promoters in their sole discretion to be in violation of the preceding criteria will not be published or removed immediately, will be void and will not result in Competition entry.

 

GRANTING OF RIGHTS IN COMMENT 

 

  1. 40.    Participation in the Competition will require for example that your name, Facebook or Instagram account and photo be displayed on Facebook or Instagram. SHOULD YOU NOT AGREE THERETO, DO NOT ATTEMPT TO ENTER THE COMPETITION. Winners have the right to decline permission to use their name or image in marketing material or participate in any marketing activity. Should the winner verbally or otherwise agree to it, the Promoters may publish the winner’s name and images on, including but not limited to, the Promoters’ Facebook page, Instagram account or website, if applicable, without any liability to the Promoters or remuneration due to the winners. 

 

  1. 41.    The Participant grants to the Promoters the non-exclusive, irrevocable, perpetual, worldwide, royalty-free, transferable, sub-licensable right and license to use, perform, exhibit, reproduce and/or otherwise exploit the comment in any manner and in any and all distribution channels, venues or media now known or hereafter devised, without further notice or any compensation to Participant. Participant further agrees, upon the Promoters’ request and without compensation, to sign any and all necessary and appropriate documents so as to effect, perfect or record such grant of license rights.

 

PUBLICITY AND DATA PRIVACY

 

  1. 42.    By entering, a Participant acknowledges that personal information about the Participant will be shared with the Promoters and their agents to the extent necessary to conduct the Competition and for prizes to be delivered to prize winners.

 

  1. 43.    All personal information relating to the Participants will be used solely in accordance with South African consumer and data protection legislation.

 

  1. 44.    Nothing in these terms and conditions is intended to, or must be understood to, unlawfully restrict, limit or avoid any rights or obligations, as the case may be, created for either the Participant or the Promoters in terms of the Consumer Protection Act.

 

GENERAL

 

  • Γ    Please note that the following terms require you to take on risk, limit the liability of the Promoters and indemnify the Promoters. Please read them carefully and contact the Promoters if you have any questions!

 

  1. 45.    The Promoters reserve the right to extend, reasonably shorten, suspend the time period of the Competition or terminate the Competition whenever it should so choose for technical, commercial, or operational reasons, or for reasons beyond its control or generally for any reason whatsoever within their sole discretion. The Competition, its prizes, and terms and conditions may be amended by the Promoters, at any time during the Competition, and will be applied and interpreted within their sole discretion. In such an event, all Participants waive any rights that they may have/purport to have in terms of this Competition, and acknowledge that they will have no recourse against the Promoters whatsoever.

 

  1. 46.    All publicity and other materials will be the sole property of the Promoters. 

 

  1. 47.    Participants confirm by their entry into the Competition that Facebook and/or Instagram are not the promoters of this Competition, it is in no way sponsored, endorsed or administered by or associated with Facebook or Instagram and they fully release Facebook and Instagram from any liability in connection with this Competition. Any questions, comments or complaints regarding the Competition are to be directed to the Promoters.

 

  1. 48.    The Promoters are not responsible for –

 

    • •    entries that are lost, late, illegible/garbled, corrupted, misdirected, defective, inaccessible, compromised, incomplete, damaged or delayed and all such entries are void and will not result in Competition entry;

 

    • •    any entry that is not delivered, received or is delayed or damaged due to technical reasons or failure on the part of your service provider. Proof of sending is not proof of receipt. Participants are responsible for their own costs of connecting to the Facebook or Instagram account.

 

    • 49.    To the fullest extent permitted by law, by participating, the Participant indemnifies, releases and agrees to hold harmless the Promoters, their associated, holding and subsidiary companies, and its directors, officers, agents, representatives, shareholders, employees, successors and assigns from any and all claims or liability arising from participating in the Competition, any Competition-related activity and/or acceptance, receipt, possession or use/misuse of any prize. 

 

    • 50.    To the extent permitted by law, the Promoters will not be liable in any way whatsoever, for any claims arising from loss, injury, damage or costs, suffered by a Participant in relation to this Competition or the prizes offered, including but not limited to claims relating to defects in the prizes or any losses caused by such defects or losses arising from incorrect or inaccurate information supplied by Participants.

 

    • 51.    The Promoters will not be liable for any loss suffered as a result of incomplete or incorrect information provided.

 

    • 52.    South African law shall govern these competition terms and conditions and the courts of South Africa shall have exclusive jurisdiction. 

 

    • 53.    By entering this Competition Participants agree to the aforementioned terms and conditions.
